Terms of Service
These Terms of Service govern your use of the Melco Tools website and your purchase of goods from Melco Tools, a brand of Footprint Sheffield Ltd ("we", "us", "our"). By using this website or placing an order, you agree to these terms.
1. Products and pricing
We take care to describe our products and specifications accurately. Occasionally an error in price or description may occur; if so, we reserve the right to cancel the order and refund any payment taken.
Prices are shown in GBP and, where applicable, include VAT. Delivery charges are shown separately at checkout.
2. Orders
Your order is an offer to buy. A contract is formed when we send you a dispatch confirmation.
We may refuse or cancel an order before dispatch for reasons including stock availability, pricing or description errors, suspected fraud, or where we are unable to supply the goods.
If we cancel an order after taking payment, we will refund the amount paid.
3. Payment
Payment is taken at the time of order through our secure checkout.
We do not store your full payment card details.
4. Cancellations and returns
Consumer cancellation and return rights are set out in our Refund & Returns Policy, including the 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Nothing in these terms affects your statutory rights.
5. Product use and safety
Our tools are designed primarily for professional and trade applications.
Products must be used safely, for their intended purpose, with appropriate training and personal protective equipment, and in accordance with any instructions, warnings or safety guidance supplied with the product.
We are not responsible for loss, injury or damage to the extent that it is caused by misuse, unauthorised modification, failure to follow supplied safety instructions, or use of a product outside its intended purpose.
Nothing in this section excludes or limits liability where the product is defective, where we have been negligent, or where liability cannot lawfully be excluded or limited.
6. Liability
Nothing in these terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- defective products where liability cannot lawfully be excluded or limited; or
- any other liability that cannot be excluded or limited by law.
If you are a consumer, nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015.
We will be responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.
If you are purchasing in the course of a business, different legal rules may apply and any limitation of liability will be subject to applicable law.
7. Privacy
Your personal data is handled in accordance with our Privacy Policy.
8. Changes to these terms
We may update these terms from time to time.
The version that applies to your order is the version published on this website at the time you place your order.
9. Governing law
These terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you retain the benefit of any mandatory protections provided by the law applicable where you live, and you may bring legal proceedings in the courts applicable to your part of the United Kingdom.
If you are purchasing in the course of a business, these terms are governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction.
